These General Terms and Conditions of Sale (GTCS) exclusively govern the contractual relationship between FRANCE PASSION© (hereinafter referred to as “the Publisher”) and any person (hereinafter referred to as “the Buyer”, “the Customer” or “the Member”) making a purchase on the official website www.france-passion.com, whether for the printed Guide or the digital edition (Ebook).

Article 1 – Purpose of the Contract

The purchase of a product or service through this website implies the Customer’s full and unconditional acceptance of these Terms and Conditions of Sale. They define the contractual provisions between the Publisher and the Customer, whether acting as a professional or as a private consumer.

Article 2 – Products and Access

2.1 Printed Guide:
The Stopover Guide is published annually in March. It lists the stopover locations available at host properties within the network.

2.2 Digital Guide (Ebook):
This is a dematerialised version accessible online via a secure personal account. Access is limited to the validity period of the current annual membership.

2.3 Use:
All content (texts, photographs, maps, databases) is protected by copyright law. Access is strictly personal, individual and reserved for the Member’s private use.

Article 3 – Prices and Orders

  • Prices: Prices are stated in euros, all taxes included (VAT). The Publisher reserves the right to modify prices at any time; however, products are invoiced based on the rate in force at the time the order is validated.

  • Postage included.

  • Validation: The Customer receives a confirmation email once the order has been validated. The Publisher retains ownership of the items until full payment has been received. Any order constitutes acceptance of the prices and descriptions of the products.

Article 4 – Payment Terms

Payment is due immediately upon ordering and may be made by the following means:

  • Credit Card: Secure payment via SSL protocol (only the bank has access to the card number).

  • Cheque: Payable to FRANCE PASSION (euros only).

  • Bank Transfer.

Article 5 – Delivery and Lead Times (Physical Products)

Guides are shipped using the “Lettre Verte” postal service. From 25 March onwards, any order placed before 12:00 noon (Monday to Friday) is dispatched the same day, subject to stock availability.

  • France: 3 to 5 days.

  • Europe: 8 to 12 days (Express delivery: 5 to 6 days).

Article 6 – Right of Withdrawal and Cancellation

  • Printed Guide: In accordance with the law, the Customer has a right of withdrawal (unless otherwise stipulated by law).

  • Digital Content (Ebook): In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a physical medium once performance has begun (access to the Ebook). By accessing the Ebook, the Buyer expressly waives their right of withdrawal.

Article 7 – Intellectual Property and Digital Use

Any reproduction or distribution, in whole or in part, is strictly prohibited.

  • PDF/Epub version: Provided exceptionally upon request for offline consultation. This file is protected by a unique, encrypted digital key.

  • Sanctions: This key makes it possible to trace the origin of any unauthorised distribution. Any unauthorised sharing or account misuse may result in immediate termination of access without refund and may lead to legal proceedings.

Article 8 – Liability

The Publisher endeavours to provide 24/7 access to the digital service but cannot be held responsible for interruptions due to internet network issues or maintenance operations. The Publisher shall not be held liable for inaccurate information provided by hosts or for changes in their activity during the year.

Article 9 – Personal Data Protection

In accordance with the GDPR, the information collected is necessary for managing membership. The Buyer has the right to access, rectify and delete their personal data by contacting the France Passion customer service.

Article 10 – Applicable Law and Disputes

These GTCS are governed by French law. In the event of a dispute, an amicable solution shall be sought as a priority before any legal action is brought before the competent courts of the Publisher’s registered office.
